NA-ME ENDÜSTRİ ÜRÜNLERİ SANAYİ VE DIŞ TİCARET A.Ş. – KVKK AYDINLATMA METNİ

7 Nisan 2016 tarihinde yürürlüğe giren 6698 nolu Kişisel Verileri Koruma Kanunu kapsamında; Yapılacak iş görüşmelerinde, talep etmiş olduğumuz ya da bizimle paylaşmış olduğunuz kişisel verilerinizin, kaydedilebileceğini, depolanabileceğini, muhafaza edilebileceğini, yeniden düzenlenebileceğini, kanunen bu kişisel verileri talep etmeye yetkili olan kurumlar ile paylaşılabileceğini ve KVKK’nın öngördüğü şartlarda, yurtiçi veya yurtdışı üçüncü kişilere aktarılabileceğini, devredilebileceğini, sınıflandırılabileceğini ve KVKK’da sayılan sair şekil ve usullerle işlenebileceğini, KVKK ve İmha Politikası’nda yazılı şartların gerçekleşmesi halinde kişisel verilerinizin yok edilebileceğini, silinebileceğini yahut anonim hale getirilerek imha edilebileceğini bildiririz.

İŞLENEN KİŞİSEL VERİLER

Çalışan olarak iş başvurusu, işe alım ve takip eden iş süreçlerinde işlenebilecek kişisel verileriniz ve açıklamaları aşağıdaki gibidir;

Kimlik Bilgisi Ad-soyadı, tüm kimlik bilgileri, uyruk, medeni durumu, doğum yeri ve tarihi, T.C. kimlik numarası, cinsiyet, imza bilgisi, SGK numarası

İletişim Bilgisi Telefon numarası, gerekli durumlarda ulaşmak işin yedek kişi telefon bilgisi, adres bilgisi, e-posta adresi

Eğitim Bilgisi Öğrenim durumu, sertifika aldığı kurs ve seminer bilgileri, yabancı dil bilgisi, çalışma hayatı süresince aldığı eğitimler ve performans bilgileri, diploma bilgileri, özgeçmiş bilgileri.

Finansal Bilgi Finansal ve maaş detayları, prim listesi, icra takip ve borç bilgileri, banka bilgileri, asgari geçim indirimi bilgisi,

İşitsel Veri Ses kayıtları

Özel Nitelikli Kişisel Veri Engelli durumu, sağlık raporları, sağlık beyan belgesi, sağlık raporları, hamilelik bilgileri, meslek hastalığı kayıtları, işe giriş muayene formu, günlük hasta şikâyetleri, akciğer grafisi, işitme testi, göz muayenesi, kan grubu bilgisi, sabıka kaydı, nüfus cüzdanı (eski) içerisinde yer alan din bilgisi hanesi, ehliyet belgesi içerisinde yer alan kan grubu hanesi. Özel nitelikli kişisel veriler açık rıza alınmaksızın işlenmemektedir.

ÇALIŞANLARIN KİŞİSEL VERİLERİNİ İŞLEME AMACIMIZ

▪ İşe alım sürecini tamamlamak,

▪ Çalışacağı departmana uygunluğunun görevinin ilgili birime uygunluğunun tespiti,

▪ Şirket ve müşteri güvenliğinin sağlanması,

▪ Çalışanların eğitim ve performans değerlendirmeleri,

▪ Çalışanların iç ve dış menfaatleri doğrultusunda veri işleme faaliyetleri (ör; özlük hakları, servis, bireysel emeklilik, özel sağlık sigortası, vb)

Kayda alınan Kişisel Veriler yasa ve hukuka uygun şekilde muhafaza edilecek ve ilgili mevzuatta belirtilen veya işlendikleri amaç için gerekli olan azami süre ve herhalde kanuni zamanaşımı süreleri kadar muhafaza edilecektir.

ÇALIŞAN KİŞİSEL VERİLERİNİN ÜÇÜNCÜ KİŞİLER İLE PAYLAŞILMASI

NA-ME ENDÜSTRİ ÜRÜNLERİ SANAYİ VE DIŞ TİCARET A.Ş. olarak yasalar ve ilgili taraflar (Müşteriler, Tedarikçiler,

Çalışanlar vs.) karşısındaki yükümlülüklerini ifa etmesi amacıyla kişisel verileriniz listelenenler ile sınırlı kalmamak üzere, kamu kurum ve kuruluşları, sigorta firmaları, sağlık kuruluşları, finansal (banka vb.) kuruluşlar, yemek, araç kiralama, operatör şirketleri vb. ile paylaşılabilecektir.

KVKK’NIN 11. MADDESİ UYARINCA HAKLARINIZ

NA-ME ENDÜSTRİ ÜRÜNLERİ SANAYİ VE DIŞ TİCARET A.Ş. olarak çalıştığınız şirketin, kişisel verileri işleyip işlemediğini öğrenmek ve bilgi talep etmek,

Kişisel verilerinizin işlenme amacını sormak ve KVKK yasasına uygun amaçla kullanılıp kullanılmadığı öğrenmek,

Kişisel verilerinizin yurtiçi ve yurtdışına aktarılıp aktarılmadığı, aktarılıyor ise kimlere aktarıldığını öğrenmek gibi haklara sahipsiniz.

Kişisel verilerinizin yanlış, eksik olduğu durumlarda düzeltilerek aktarımın yapılmasını sağlamak hakkına sahipsiniz.

Ayrıca;

Kişisel verilerinizin KVKK madde 7 gereği ve uyarınca uygun şartlarda imha edilmesini (silinmesini ve yok edilmesi) talep edebilir ve aktarımının yapıldığı taraflardan imha edilmesini (silinmesi ve yok edilmesini) talep edebilirsiniz.

Kişisel verilerinizin KVKK’na aykırı bir şekilde işlenmiş olmasından dolayı zarara uğramanız halinde zararın giderilmesini talep edebilirsiniz.

Kişisel verilerinizin işlenmesi ile ilgili hususlarda başvurunuzu Şirketin internet adresinde bulunan başvuru formunu (https://na-me.com.tr/bizimle-iletisime-gecin/) doldurup, formda belirtildiği gibi şirketimize teslim etmeniz gerekmektedir.

Şirketimiz talebin uygunluk durumuna ve niteliğine göre en geç otuz gün içinde ilgili talebi ücretsiz olarak sonuçlandıracak olup, cevaplama sürecinin ayrıca bir maliyet doğurması halinde, ilgili mevzuat çerçevesinde belirlenen tutarlarda ücret talep edilebilecektir.

Başvuru Hakkının İstisnaları

KVK Kanunu’nun 28. maddesi gereğince kişisel veri sahiplerinin aşağıda yer alan konularda haklarını ileri sürmeleri mümkün olmayacaktır.

  • Kişisel verilerin resmi istatistik ile anonim hale getirilmek suretiyle araştırma, planlama ve istatistik gibi amaçlarla işlenmesi
  • Kişisel verilerin milli savunmayı, milli güvenliği, kamu güvenliğini, kamu düzenini, ekonomik güvenliği, özel hayatın gizliliğini veya kişilik haklarını ihlal etmemek ya da suç teşkil etmemek kaydıyla sanat, tarih, edebiyat veya bilimsel amaçlarla ya da ifade özgürlüğü kapsamında işlenmesi
  • Kişisel verilerin milli savunmayı, milli güvenliği, kamu güvenliğini, kamu düzenini, ekonomik güvenliği sağlamaya yönelik olarak kanunla görev ve yetki verilmiş kamu kurum ve kuruluşları tarafından yürütülen önleyici, koruyucu ve istihbari faaliyetler kapsamında işlenmesi
  • Kişisel verilerin soruşturma, kovuşturma, yargılama veya infaz işlemlerine ilişkin olarak yargı makamları veya infaz mercileri tarafından işlenmesi KVK Kanunu’nun 28/2 maddesi gereğince; aşağıda sıralanan hallerde zararın giderilmesini talep etme hariç olmak üzere, kişisel veri sahiplerinin haklarını ileri sürmeleri mümkün olmayacaktır.
  • Kişisel veri işlemenin suç işlenmesinin önlenmesi veya suç soruşturması için gerekli olması
  • Kişisel veri sahibinin kendisi tarafından alenileştirilmiş kişisel verilerin işlenmesi
  • Kişisel veri işlemenin kanunun verdiği yetkiye dayanılarak görevli ve yetkili kamu kurum ve kuruluşları ile kamu kurumu niteliğindeki meslek kuruluşlarınca denetleme veya düzenleme görevlerinin yürütülmesi ile disiplin soruşturma ve kovuşturması için gerekli olması
  • Kişisel veri işlemenin bütçe, vergi ve mali konulara ilişkin olarak devletin ekonomik ve mali çıkarlarının korunması için gerekli olması

Within the scope of the Law on the Protection of Personal Data (KVKK) No. 6698, which entered into force on April 7, 2016; We hereby inform you that the personal data we have requested or that you have shared with us during job interviews may be recorded, stored, preserved, reorganized, shared with institutions legally authorized to request such personal data, and—under the conditions foreseen by the KVKK—may be transferred to domestic or foreign third parties, assigned, classified, and processed through other means and procedures listed in the KVKK. Furthermore, strictly subject to the fulfillment of the conditions written in the KVKK and the Destruction Policy, your personal data may be destroyed, deleted, or anonymized.

PROCESSED PERSONAL DATA

The personal data that may be processed during your job application as an employee, recruitment, and subsequent business processes, along with their descriptions, are as follows:

Identity Information: Name-surname, all identity details, nationality, marital status, place and date of birth, T.C. (Turkish Republic) Identity Number, gender, signature information, Social Security (SGK) number.

Contact Information: Phone number, backup contact phone information for necessary situations, address information, e-mail address.

Education Information: Education status, information on courses and seminars attended/certified, foreign language knowledge, training received during working life and performance information, diploma details, CV information.

Financial Information: Financial and salary details, bonus/premium lists, execution proceedings and debt information, bank details, Minimum Living Allowance (AGI) information.

Audio Data: Voice recordings.

Special Categories of Personal Data (Sensitive Data): Disability status, health reports, health declaration documents, pregnancy information, occupational disease records, pre-employment medical examination forms, daily patient complaints, chest radiography (lung X-ray), hearing tests, eye examinations, blood type information, criminal records, religion information field located on (old format) identity cards, blood type field located on driver’s licenses. Special categories of personal data are not processed without obtaining explicit consent.

Employment Data: Registry number, position name, department and unit, title, last employment entry date, entry-exit dates, insurance entry/retirement, social security number, flexible working hours status, travel status, number of working days, projects worked on, monthly total overtime information, severance pay base date, severance pay additional days, days spent on strike, employee internet access logs, entry-exit logs.

Leave Data: Leave seniority base date, leave seniority additional days, leave group, exit/return date, days, reason for leave, address/phone while on leave.

Other: Military service status, performance information, family notification information.

OUR PURPOSE FOR PROCESSING EMPLOYEES’ PERSONAL DATA

  • To complete the recruitment process,
  • Determination of suitability for the department and the relevance of the duty to the related unit,
  • Ensuring company and customer security,
  • Employee training and performance evaluations,
  • Data processing activities in line with the internal and external interests of the employees (e.g., personnel rights, shuttle service, private pension, private health insurance, etc.),
  • Execution of financial processes (salary, premiums, etc.),
  • Usage in line with the legitimate interests of the Company, provided that it does not violate the fundamental rights and freedoms and personal interests of individuals and remains in compliance with the laws,
  • Legal compliance reasons (Compliance with the Law on Private Security Services and other legislation),
  • Domestic and international training, assignment, auditing, and similar business requirements.

Recorded Personal Data will be preserved in accordance with the law and legislation, for the maximum period specified in the relevant legislation or required for the purpose for which they are processed, and in any case, for the statutory limitation periods.

SHARING OF EMPLOYEE PERSONAL DATA WITH THIRD PARTIES

As NA-ME ENDÜSTRİ ÜRÜNLERİ SANAYİ VE DIŞ TİCARET A.Ş., in order to fulfill its obligations towards the laws and relevant parties (Customers, Suppliers, Employees, etc.); your personal data may be shared with public institutions and organizations, insurance companies, health institutions, financial (bank, etc.) institutions, catering, car rental, operator companies, etc., strictly limited to the listed entities.

YOUR RIGHTS PURSUANT TO ARTICLE 11 OF THE KVKK

As NA-ME ENDÜSTRİ ÜRÜNLERİ SANAYİ VE DIŞ TİCARET A.Ş., you have the following rights regarding the company you work for:

  • To learn whether personal data is processed or not and to request information,
  • To ask the purpose of processing your personal data and whether it is used in accordance with the KVKK law,
  • To learn whether your personal data is transferred domestically or abroad, and if so, to whom it is transferred.
  • To request the rectification of incomplete or inaccurate data and to ensure that the transfer is made accordingly.

Furthermore:

  • You may request the destruction (deletion and disposal) of your personal data under appropriate conditions pursuant to Article 7 of the KVKK and request that the parties to whom the transfer was made also destroy (delete and dispose of) it.
  • You may request compensation for damages in case you suffer damage due to the processing of your personal data in violation of the KVKK.
  • For applications regarding the processing of your personal data, you must fill out the application form found on the Company’s internet address (https://na-me.com.tr/bizimle-iletisime-gecin/) and submit it to our company as specified in the form.

Our Company will conclude the relevant request free of charge as soon as possible and within thirty days at the latest, depending on the nature of the request. However, if the transaction requires an additional cost, a fee may be charged in the amounts determined within the framework of the relevant legislation.

Exceptions to the Right of Application

Pursuant to Article 28 of the KVK Law, it will not be possible for personal data owners to assert their rights in the following matters:

  • Processing of personal data for purposes such as research, planning, and statistics by anonymizing them with official statistics.
  • Processing of personal data for artistic, historical, literary, or scientific purposes, or within the scope of freedom of expression, provided that it does not violate national defense, national security, public security, public order, economic security, privacy of private life, or personal rights, and does not constitute a crime.
  • Processing of personal data within the scope of preventive, protective, and intelligence activities carried out by public institutions and organizations authorized by law to ensure national defense, national security, public security, public order, or economic security.
  • Processing of personal data by judicial authorities or execution authorities in relation to investigation, prosecution, trial, or execution proceedings.

Pursuant to Article 28/2 of the KVK Law; in the following cases, except for the right to demand compensation for damage, it will not be possible for personal data owners to assert their rights:

  • Processing of personal data is necessary for the prevention of committing a crime or for a criminal investigation.
  • Processing of personal data made public by the personal data owner strictly themselves.
  • Processing of personal data is necessary for the execution of supervision or regulation duties, and for disciplinary investigation or prosecution by authorized and responsible public institutions and organizations and professional organizations in the nature of public institutions, based on the authority given by the law.
  • Processing of personal data is necessary for the protection of the economic and financial interests of the State regarding budget, tax, and financial matters.
